The TipShout application, hereinafter referred to as the "Application", provides a matchmaking service designed to facilitate the exchange of recommendations.
Accessing, browsing, and using the Application implies unreserved acceptance of these Terms and Conditions of Use.

The Application is hosted by Amazon Web Services Inc., P.O. Box 81226, Seattle, WA 98108-1226.
Application: refers to the mobile application operated by BringMeBiz SAS.
BringMeBiz: refers to the company BringMeBiz SAS, a simplified joint-stock company with a share capital of €10,000, with its registered office at 3 rue Buenos Aires, 75007 Paris, France, registered in the Grasse Trade and Companies Register under number 833 141 880.
TIPSHOUT Service: refers to the services made available to Users by BringMeBiz SAS.
User: refers to any person registered on the Application.
The Terms and Conditions of Use (hereinafter referred to as the "T&Cs") are intended to define the conditions of use of the TIPSHOUT Service made available to Users.
Each User declares to have read these T&Cs and expressly accepts them without reservation and/or modification of any kind.
The User acknowledges that interruptions may occur, particularly due to the variable reliability of transmissions over the infrastructure and networks on which they travel.
The User acknowledges that it is their responsibility to take the necessary measures to secure their equipment and data, particularly against viruses or hacking.
BringMeBiz cannot be held liable for any damage resulting from connection to the Application.
The User agrees to keep their login credentials and passwords confidential, and may not hold BringMeBiz liable in the event of fraudulent connection or use.
The User acknowledges that any connection to their account will be deemed to have been made by themselves.
The User accepts that, for technical reasons, the publication of their recommendation will not be instantaneous following its creation.
The User accepts that the recommendations they publish on the Application may be shared by any User on other networks such as Facebook, LinkedIn, Instagram or Twitter.
The User acknowledges that by using the Application, they accept that their profile is public, meaning that everyone can see their content (recommendations, photos, videos, comments, etc.).
The TIPSHOUT Service includes, among other things:
Creating recommendations and publishing photos and videos
Viewing recommendations
Geolocating recommendations
Searching for recommendations
Saving recommendations
Searching for Users and the ability to follow other users
Adding comments to recommendations
The TIPSHOUT Service is free for all Users.
The processing of personal data is governed by our privacy policy, which forms an integral part of these T&Cs.
BringMeBiz reserves the right to delete, without prior notice or notification, and without compensation or right to reimbursement, any content that does not comply with the Terms and Conditions of Use and/or that may infringe the rights of a third party or of BringMeBiz.
Any User may report a recommendation, a comment, or content in general, or another User in the event of non-compliance with the Terms and Conditions of Use.
Each User agrees to use and operate the TIPSHOUT Service and each recommendation in compliance with applicable regulations and in particular to respect the rights of third parties.
The User agrees that the information entered in their account does not infringe the rights of any third party.
The User declares in particular that such information is their sole responsibility.
The User declares that they are at least 13 years old at the time of account creation.
Each User acknowledges that they are solely responsible for their use of the TIPSHOUT Service, their statements and/or their data and content. They guarantee BringMeBiz against any prosecution or conviction that may be brought against it as a result, expressly releases BringMeBiz from all liability, and agrees to bear any resulting costs (damages, legal fees, etc.).
Each User agrees to behave in a respectful and fair manner towards other users.
In particular, the User agrees:
- not to violate any applicable regulations
- to be careful about personal information they share
- not to make inappropriate, violent, abusive, shocking, obscene, indecent, defamatory, discriminatory, racist, paedophilic, pornographic, illegal, or generally immoral statements
- to respect the right to image, intellectual property rights, copyright, and the right to privacy
- not to make false or misleading statements
- not to make statements that encourage the sale of prohibited goods or services
- not to make statements that infringe or encourage the infringement of the rights and functioning of the TIPSHOUT Service
- not to send messages or content that may cause the TIPSHOUT Services to malfunction (software, viruses, etc.), or mass messages.
BringMeBiz reserves the right to delete any recommendation, comment, or content in general that does not comply with the terms of use, and to delete or suspend the account of any User who has not complied with them, without notice or notification and without compensation.
Users acknowledge that they are solely responsible for the messages they exchange with each other and that BringMeBiz cannot in any event be held liable.
Each User acknowledges being informed that routinely facilitating, even incidentally, transactions involving the goods or services of others is a regulated activity.
Consequently, each User declares to be in compliance with the provisions of law no. 70-9 of 2 January 1970, known as the "Hoguet Law".
If they do not hold an authorisation under this law, they declare that they are only occasionally involved in transactions relating to the goods or services of others.
Any User may unsubscribe from the Application at any time.
BringMeBiz, which is limited to hosting User content, is subject to the reduced liability regime for hosting providers provided for in articles 6.I.2 et seq. of law no. 2004-575 of 21 June 2004 on confidence in the digital economy.
BringMeBiz can therefore in no event be held liable for content published by Users and messages exchanged, and provides no warranty, express or implied, in this regard.
BringMeBiz is a third party to the correspondence and relations between Users, and therefore excludes all liability in this regard.
BringMeBiz cannot be held liable for interruptions, modifications, or malfunctions of the TIPSHOUT Service.
BringMeBiz undertakes to implement all necessary means to best ensure the provision of the TIPSHOUT Service to Users.
BringMeBiz cannot be held liable for the loss of data or information stored by BringMeBiz, or for direct or indirect loss or damage of any kind resulting from the content of recommendations and messages, the use, management, operation, interruption, or malfunction of the TIPSHOUT Service.
It is the Users' responsibility in particular to take all necessary precautions to preserve the recommendations they publish on the Application.
BringMeBiz cannot be held liable in the event of temporary inability to access the Application resulting from technical problems of any kind.
BringMeBiz reserves the right, at any time, to modify or interrupt access to the Application or all or part of the TIPSHOUT Service.
Each User acknowledges that BringMeBiz plays no part in any legal relationship between Users, and that it is their responsibility to carry out the usual checks, particularly of a legal nature, before entering into any agreement with another User.
Some information on addresses provided by the Application comes from sources considered reliable. However, this information is provided for information purposes only and cannot be considered as advice or recommendations. Furthermore, BringMeBiz cannot guarantee its accuracy.
All intellectual property rights relating both to the general structure of the Application and to its content (slogans, texts, images, photos, videos, sounds, graphics, logos, databases, etc.) are the property of BringMeBiz. Any total or partial reproduction, representation, modification, or exploitation of the Application or its content without the prior authorisation of BringMeBiz is prohibited and constitutes an infringement. As such, the criminal and civil liability of its author may be engaged.
The BringMeBiz and TipShout trademarks and logos are registered trademarks. Any total or partial reproduction without the prior authorisation of BringMeBiz is prohibited.
In general, the logos, trademarks, domain names, corporate names, trade names, and other distinctive signs of BringMeBiz and TipShout and/or its partners mentioned on the Application may not be used without the prior authorisation of their owner. Any total or partial reproduction, representation, or exploitation is therefore prohibited.
Hyperlinks present on the Application and redirecting to other websites or mobile applications cannot engage the liability of BringMeBiz. The User is solely responsible for activating them.
Each User owns the content they upload to the Application. However, they grant BringMeBiz the right to use this content (text, logos, photos, videos, trademarks, etc.).
The User grants BringMeBiz in particular the right to broadcast, reproduce, modify, or adapt their content for advertising, commercial, or other purposes.
The User authorises BringMeBiz in particular to reproduce their recommendations on the various social networks, in particular Facebook, Instagram, LinkedIn, and Twitter, whose terms and conditions of use they acknowledge accepting.
BringMeBiz reserves the right to modify, in whole or in part, the T&Cs and the TIPSHOUT Service. By using the Application, Users accept the changes made.
If any part of the T&Cs should prove to be illegal, invalid, or unenforceable, for whatever reason, the provisions in question shall be deemed unwritten, without calling into question the validity of the other provisions which shall continue to apply between Users and BringMeBiz.
This Privacy Policy, which forms an integral part of the T&Cs, is intended to describe in a transparent manner how BringMeBiz processes Users' personal data and the reasons for such processing.
BringMeBiz is the controller of Users' data, collected during use of the TIPSHOUT Service.
BringMeBiz may collect data that the User enters directly when using the TIPSHOUT Service.
This is the case in particular when creating an account, filling in profile fields, creating a recommendation, publishing comments, or sending messages to BringMeBiz teams.
Among the data collected are, without limitation, the User's title, last name, first name, company name, SIRET number, email address, date of birth, telephone number, postal address, city, postcode, profession, employer, and identity document.
Providing certain information may be optional.
BringMeBiz also collects data resulting from the User's use of the TIPSHOUT Service. This may include, for example, data collected from viewing a recommendation or category, a search, creating a recommendation, or publishing a comment.
While browsing the Application, BringMeBiz uses cookies and Users' IP addresses in particular to identify them and record their activity.
BringMeBiz may also collect personal data about the User through clients or partners.
The personal data we collect enables us in particular:
to create and manage your account
to follow other Users
to create your recommendations
to publish comments
to respond to your messages sent to BringMeBiz teams
to send you newsletters or commercial offers
to analyse how you use the TIPSHOUT Service and to produce statistics
to improve the TIPSHOUT Service through a better understanding of Users
to personalise your experience by adapting the content you have access to
to personalise advertising based on your geolocation and to present you with commercial proposals from partners, subject to having obtained your consent
to combat any breach of the T&Cs
to comply with legislation and meet our legal obligations
The personal data collected by BringMeBiz is accessible by its technical service providers acting as subcontractors. The outsourced technical services include, for example, hosting or advertising technology.
In this context, certain personal data may be transferred outside the European Union. Such transfers are governed by legal provisions.
Some of our service providers (advertising providers, etc.) may collect your personal data as data controllers, subject to having obtained your consent.
BringMeBiz may be required to communicate your personal data to administrative or judicial authorities authorised by law, in order to comply with its legal obligations or in the event of an offence or breach of the T&Cs.
Each User has the following rights:
Right of access, which enables you to obtain confirmation that your data is being processed and to access it.
Right to rectify and update your data
Right to delete your data, subject to BringMeBiz's legal retention obligations.
Right to restriction, which enables you to temporarily freeze the use of your data.
Right to portability, which enables you to receive your data in a structured, machine-readable format and to transmit it to another data controller.
Right to object, which enables you to object to the processing of your data, except in cases of legitimate and compelling reasons on the part of BringMeBiz.
Right not to be subject to a decision based solely on automated processing, except where this is necessary for the conclusion or performance of a contract or where it is legally authorised.
Right to issue instructions regarding the fate of your personal data after your death.
Each User may exercise their rights of access, rectification, or deletion via their profile.

Personal data is retained for as long as necessary to fulfil the purposes for which it was collected and in accordance with applicable legislation.
For example, data relating to accounts and recommendations is retained for 5 years from their deletion, and data relating to prospects is retained for 3 years from the last contact initiated by the prospect.
BringMeBiz uses a range of measures to ensure the protection of personal data, such as the implementation of firewalls, storage of data on secure servers, and access controls.
Cookies are text files stored on the hard drive of your device (computer, mobile phone, tablet) by your browser when you visit an online service. They enable your device to be identified for the duration of their validity.
